1. When you attend our Potts Point studio, or use our website from New South Wales, you are contracting with One Hot Yoga Sydney Pty Ltd ACN 169 300 430 as trustee for the OHP Trust, ABN 51 729 531 625. Our Potts Point studio is at 34 Kellett Street, Potts Point, New South Wales 2011.
2. In these terms, “we”, “us” and “our” mean that company. Appendix B applies to you.
3. Our South Yarra studios in Victoria are run by a different company, One Hot Yoga Pty Ltd ACN 158 512 746 as trustee for the One Hot Yoga Family Trust, under separate terms at onehotyoga.com.au/student-terms-conditions-vic. If you practise at both studios, each company is responsible for what it supplies at its own studio.
4. Buying a membership, pass or class, or entering a studio, means you accept these terms. You are taken to have read them and to agree to them.
5. These terms live at onehotyoga.com.au/student-terms-conditions-nsw, with the date they took effect. There is a printed copy at reception. Ask and we will give it to you.
6. We may change these terms where there is good reason to, including a change in the law, in what we offer, or in what things cost us.
7. Keep your contact details current so we can reach you about bookings, payments and changes.
8. Class means a scheduled group class, including a Studio Pilates small group class.
9. Appointment means a private session, an initial consultation, or any other session booked for you or a nominated small group at a set time with a nominated teacher.
10. Membership means any membership, pass, class pack or intro offer giving access to classes or appointments.
11. Unlimited membership means an ongoing membership with no cap on how many classes you attend.
12. Representatives means our directors, officers, employees, teachers, contractors, consultants and agents.
13. Activities means yoga classes, Pilates classes, workshops, exercise, stretching, breathwork, meditation and any other activity we provide.
14. Released Parties has the meaning given in the appendix that applies to you.
15. You need to be 18 to hold a membership in your own name. Between 15 and 17, a parent or guardian signs our contract and takes responsibility for the fees. We do not take members under 15.
16. We may refuse entry or ask someone to leave if they are behaving unsafely, aggressively or offensively towards anyone, our team included, if they are affected by alcohol or drugs to the point it is not safe for them to practise, or if they are making it hard for other people to use the studio or feel comfortable in it. Our rooms are heated, and alcohol changes how your body copes with that, so this is a safety matter as much as a courtesy one.
17. Please do not photograph or film anyone at the studio without their consent. That includes reception and the change rooms, not just the studio rooms. Leave your phone outside the studio room. If it happens we may ask you to delete it, and we may end your membership.
18. Occasionally we photograph or film in the studio for our own marketing. We do not film public classes. If we are shooting somewhere you might appear in the background, we will put a sign up at reception before we start. Tell us if you would rather not be in it and we will work around you or not use the shot. If you turn up in something we have already published and you would like it taken down, email us and we will remove it.
19. For most things we will have a quiet word first. For anything serious, or anything that keeps happening, we may end your membership and ask you not to come back. If we do, we will tell you in writing and refund the unused part.
20. We may end a membership or pass immediately and refuse entry if someone follows, watches, waits for, repeatedly contacts, or otherwise pursues a member of our team or another member, or behaves towards them in a way that makes them fear for their safety. It does not matter whether it happens at the studio or anywhere else. We will act on a reasonable belief that it is happening, and we will not give reasons that would identify the person who raised it. No warning applies and clause 19 does not. We will refund any unused part of what you have paid, and you must not contact our team or come to our studios after that.
21. No smoking or vaping inside or immediately outside our studios.
22. Your membership gives you the regularly scheduled classes described for it at the point of purchase and in your account. Those details, including the price, the billing cycle and any expiry date, form part of your agreement with us.
23. Memberships do not include guest teacher classes, workshops, retreats, teacher training, private sessions or other special events, unless it says so at purchase. Those are booked and paid for separately.
24. A membership is yours alone. It cannot be shared, sold, gifted or transferred.
25. If we think a membership is being shared, we will come to you first and give you a chance to explain. We may then end it, and refund the unused part less our casual rate for any classes someone else attended on your membership.
26. One account per person. Intro offers and other one-per-person offers are exactly that, whatever email address or account they are taken on. If we find someone holding more than one account, we will get in touch, close or merge the extra, and charge our casual rate for any classes taken on an offer they had already used.
27. Ongoing memberships run for a minimum of 8 weeks from the day you join.
28. Class packs, casual passes and intro offers are not subscriptions. No minimum term, and they do not renew on their own.
29. Gift cards can be redeemed for at least 3 years from the day they are bought. The expiry date is on the card. They cannot be exchanged for cash, and there is no fee after purchase.
30. Your fee is the amount shown at the point of purchase, charged on the cycle shown there.
31. We charge the card or account you nominate, through Stripe.
32. Keep a valid payment method on your account for the whole time your membership runs, including while it is paused, and enough in the account to cover the charge. If your card is replaced or expires, update it before your next charge date.
33. If a payment does not go through, we will get in touch and try again:

34. You can keep booking and attending while we retry. If the third retry fails, your membership ends that day. We stop charging, and you will not be able to book. You are welcome to join again whenever you like, at the prices current then, with a new minimum term. Any unpaid amount stays owing and is payable if you rejoin. If your circumstances have changed, talk to us.
35. We cannot do anything about fees your own bank charges you for a failed payment.
36. After the minimum term we may raise the fee for an ongoing membership, with 28 days’ written notice. If you would rather not continue, cancel before it starts. No cancellation fee, and you do not serve the notice period in clause 38.
37. After the minimum term, you can cancel whenever you like. Cancel through your account, or email one@onehotyoga.com.au.
38. Cancel at least 5 days before your next billing date. If you cancel less than 5 days before your next billing date, that payment still goes through and your membership ends at the end of that period.
39. Your membership runs to the end of the period you have paid for. Part periods are not pro rated. We do not refund part of a billing period already charged, unless clause 57 applies or the Australian Consumer Law requires it.
40. After the minimum term you can suspend an ongoing membership using the form at onehotyoga.com.au/membership-suspension. Whole weeks, up to 10 weeks in any 12 months, with at least 5 days’ notice before your next billing date. We cannot pro rata part weeks. There is no suspension fee, and we do not charge membership fees while you are paused. A suspension extends your minimum term by its length.
41. Bookings open 14 days ahead, through the app or the website. Hold up to two advance bookings a day, and come to more on the day if there is space.
42. Cancel through the app or the website. We cannot take cancellations by phone, email or social media, because those do not release your place to the next person waiting.
43. The cancellation windows are:

Studio Pilates has a longer window because there are only four places, and one given up close to the start usually cannot be filled.
44. If you cancel a class inside the window, or do not come, on an unlimited membership:
On a class pack, casual pass, intro offer or limited membership, the class is counted as used and there is no fee. On a class or session you bought separately, outside your membership, the class or session is counted as used and there is no fee.
45. If you cancel an appointment or private session inside the window, or do not come, the session is counted as used. No fee, on any membership or pass.
46. These amounts cover what it costs us to hold a place someone else wanted. A no-show is more than a late cancellation because a late cancellation still gives us a chance to fill the space from the waitlist, and a no-show does not.
47. The 28 days runs backwards from each no-show, so an occasional one costs you nothing. The fee applies when they start to add up.
48. Fees under clause 44 are charged to your payment method 48 hours after the class. If a payment fails we may re-attempt it.
49. Reception opens 30 minutes before class. The door locks at the class start time, because your teacher cannot leave the room to open it. Arriving after the start counts as a no-show.
50. Do not let anyone into the studio. If someone is waiting at the door, tell reception or your teacher. Everyone who comes in has to be checked in and has to have accepted our waiver.
51. If we add you from the waitlist when the cancellation window has already passed, you have 30 minutes from that moment to take yourself out without a fee. If you already know you cannot make it, take yourself off the waitlist.
52. No fee applies under clause 44 if our booking system was down and you could not cancel.
53. We may change or cancel a scheduled class. If we cancel one you have booked we will tell you as soon as we can, and any class counted as used goes back on. Where a change or cancellation is a significant failure to give you what you paid for, you have rights under the Australian Consumer Law, and clause 56 applies.
54. We do not refund for change of mind. Packs, passes and intro offers expire on the date shown at purchase, and unused classes do not carry over.
55. Intro offers are one per person, and are not transferable or extendable.
56. Our services come with guarantees under the Australian Consumer Law that cannot be excluded. If we do not supply a service with due care and skill, or do not supply it at all, you are entitled to a remedy, which may include a refund. Nothing in these terms removes any guarantee, right or remedy that cannot lawfully be excluded, and nothing we say about refunds changes that.
57. If you have paid upfront for a fixed term and you cannot continue:

58. Yoga and Pilates ask a lot of the body, and there is a real risk of injury in any class.
59. Some of our classes are held at around 37°C, the same temperature as the body itself, and some at around 27°C. Others are not heated at all. The temperature of each class is shown when you book it. In the heated rooms there is a risk of heat illness, dehydration and light-headedness, and of overstretching, because heat softens your sense of how far you have gone.
60. Reformer classes are at room temperature. Reformer work uses a moving carriage, springs and straps under tension, and a foot bar.
61. Studio Pilates is at room temperature and uses the full apparatus, including the Cadillac and the pedipole. That means equipment under spring tension, load through the wrists and shoulders, supported positions off the floor, the possibility of falling, and the sudden release of a spring or strap. Advanced apparatus work, including inverted positions and positions where your weight is suspended, is programmed only for people a teacher has assessed as ready for it.
62. Some of what we offer goes beyond a regular class. It includes dynamic Pilates, arm balancing and inversion workshops in yoga, Studio Pilates group or private sessions for athletic or performance support, teacher training, and any other workshop we describe as advanced. These carry risks beyond a regular class, including falling from height or from a balance, injury to the wrist, elbow, shoulder or neck, spinal injury, and injury on inversion. Before you take part in any of them, you must accept our additional acceptance for advanced practice.
63. In every class there is a risk of muscle and joint injury, spinal injury, and the aggravation of something you already carry. In rare circumstances, serious injury or death.
64. Follow your teacher’s direction in class. It is how we keep you safe. Stop if you feel pain, dizziness, shortness of breath or anything else that makes you doubt you can continue safely.
65. Before class, tell us and your teacher about any injury, illness, pain, medical condition or pregnancy. It changes how we teach you. If any of it is significant, see a doctor before you practise. Our teachers are qualified in yoga and Pilates. They are not medical practitioners and cannot tell you whether exercise is safe for your particular condition. We do not give medical advice and we do not represent that any activity is suitable for your individual physical condition.
66. If you are pregnant, you cannot attend a heated class. The temperature of each class is shown when you book it. You can attend our unheated classes and our prenatal programme. Tell us as soon as you know you are pregnant. If you become pregnant while you are a member, tell us in writing before your next class, and we will move you onto what you can do.
67. Our teachers may use touch to adjust or support you. Tell your teacher any time if you would rather they did not.
68. You are responsible for deciding whether you are physically and medically able to take part.
69. The conditions below carry a heightened risk of injury or harm if you practise without modification. If any of them applies to you, you must tell us in writing before you attend. If one develops while you are a member, you must tell us in writing as soon as it does. If you have any concern about whether these activities are safe for you, raise it with a qualified medical practitioner.
Low bone density, osteoporosis or osteopenia. Loaded spinal flexion and twisting run through most of both repertoires: roll downs, forward folds, the roll up, spine stretch forward, the hundred and almost all mat abdominal work. Unmodified practice can cause a vertebral compression fracture, which can happen without trauma and without the person feeling it. Outcomes include chronic pain, height loss, kyphosis and reduced lung function. Most affected clients do not know they have low bone density.
Pregnancy. In the 37 and 27 degree rooms, maternal core temperature can rise. The evidence that exercise in pregnancy is safe was all generated at 25 degrees, and there is no evidence that a heated class keeps core temperature below the 39 degree threshold. Lying flat on the back after the first trimester, the default position in mat and reformer Pilates, compresses the vena cava and reduces blood return. Unmodified practice can lead to neural tube defects in the first trimester, maternal fainting or collapse at any stage, and falls from apparatus or during fast direction changes.
Recent illness with fever. Core temperature is already raised before a heated class starts, you are already fluid depleted, and viral illness carries a myocarditis risk that exertion makes dangerous. Unmodified practice can lead to heat stroke or a heart rhythm event.
Any condition that can cause sudden loss of control on apparatus. A seizure, vertigo attack, low blood sugar episode, faint or MS heat episode is an unpleasant event on a mat. The same event while suspended from the Cadillac, inverted or on a moving reformer carriage is a fall from height onto a hard floor or the frame. Unmodified practice can lead to fracture or head injury.
Cardiovascular disease. A heated class produces heart rates around 75 to 80 per cent of maximum, with peaks of 85 per cent for women and 92 per cent for men, in a class most clients experience as gentle. Unmodified practice can lead to cardiac arrest or heart attack. The probability is very low and the outcome is fatal.
Medications that impair sweating or blood pressure control. Diuretics, beta blockers, ACE inhibitors, ARBs, antipsychotics, tricyclic antidepressants, anticholinergic antihistamines, lithium, stimulants and topiramate reduce the body’s ability to shed heat or hold blood pressure. Standard screening does not ask about them. Unmodified practice in a heated class can lead to heat exhaustion, heat stroke, fainting and falls.
Type 1 diabetes. People with type 1 diabetes lose less heat and store more during moderate and vigorous exercise at 35 degrees. Heat and exercise also increase insulin absorption from injection sites. Neuropathy reduces foot sensation, and hot classes are barefoot on a wet floor. Unmodified practice can lead to heat illness, low blood sugar, and falls or foot lacerations.
Glaucoma. Any head below heart position raises pressure inside the eye. Downward dog produces the largest rise, larger than headstand or shoulderstand, so the exposure is in every general class, not only inversions. Unmodified practice can accelerate irreversible vision loss.
Neck or cervical spine condition, or prior neck injury. Headstand loads 40 to 48 per cent of body weight through the neck. Shoulderstand and plough load it in flexion. Unmodified practice can lead to spinal cord compression, arterial dissection and stroke.
Multiple sclerosis. A rise in core temperature of 0.2 to 0.5 degrees, which any class produces, causes a temporary loss of vision, strength and coordination in most people with MS. It resolves with cooling and does no lasting neurological harm. Unmodified practice can lead to a fall, a fall from apparatus, or being unable to leave a hot room without help.
Epilepsy. Overheating leads to dehydration and electrolyte shift, which can trigger a seizure. Forceful breath practice is voluntary hyperventilation, which reliably provokes seizure activity. This applies to our breathwork events as well as class. Unmodified practice can lead to a seizure on a hard floor, on a reformer or under apparatus.
Uncontrolled high blood pressure. Breath holding and straining produce large sudden spikes in arterial pressure. Inversions are traditionally warned against, though harm from them is not evidenced. Unmodified practice can lead to a bleeding stroke or cardiac event. The probability is very low.
Recent joint replacement. Knees to chest, pigeon, seated forward folds, the hundred, the roll up and supine reformer footwork in a narrow position breach standard hip precautions. Unmodified practice can dislocate the prosthesis, requiring reduction or revision surgery.
Hypermobility or Ehlers-Danlos. Joints reach end range without the normal stretch sensation that would warn of it. Hypermobile people are over-represented in yoga because they are good at it, and praise for depth of range harms them. Unmodified practice leads to recurrent subluxation and cumulative joint damage rather than a single acute injury.
Eating disorder or low energy availability. Sustained under-fuelling produces the bone density of a much older person, plus low blood volume, low heart rate and electrolyte disturbance. Heated classes are perceived as weight loss tools and attract this group. Unmodified practice can lead to fracture from ordinary movement, fainting on rising from the floor or in heat, and heart rhythm disturbance.
Vertigo or vestibular dysfunction. Repeated head movements through 90 degrees, as in cat and cow, are enough to provoke it. Exposure is universal across every class we run. Unmodified practice can lead to incapacitating vertigo and a fall, including from apparatus.
Disc injury or acute low back pain. Repeated loaded lumbar flexion is a plausible mechanism of disc injury, particularly early in the morning and in people with acute symptoms. Mat Pilates carries the most exposure. One in five pre-existing injuries is made worse by yoga. Unmodified practice can lead to disc herniation with nerve pain, usually recoverable.
Asthma. Warm humid air protects against exercise induced airway narrowing, so the heated room is not the risk. The risk is poorly controlled asthma meeting near maximal cardiovascular effort, heat stress itself, and mould and dust mite growth in a warm humid room. Unmodified practice can lead to a severe attack needing emergency treatment.
Recent abdominal surgery. There is no agreed timeline for return to abdominal loading, and surgeons vary widely. Unmodified practice can lead to incisional hernia or the wound reopening.
Wrist injury, including fracture, sprain or carpal tunnel. Practising without modification risks re-injury or aggravation from repeated weight bearing on the hands in downward dog, plank, arm balances and reformer or Cadillac work.
Shoulder injury, including rotator cuff, instability or dislocation history. Practising without modification risks tendon aggravation, re-dislocation or worsening instability from weight bearing on the hands, chaturanga, arm balances and loaded spring work through the arms.
Hamstring tear or hamstring origin pain. Practising without modification risks re-tearing or chronic tendon pain at the sit bone from repeated forward folds, seated forward bends and straight leg stretching.
Hip injury, including labral tear, impingement or bursitis. Practising without modification risks aggravation from deep hip flexion, pigeon, lotus, wide leg positions and deep squatting.
Knee injury, including meniscus or ligament. Practising without modification risks further cartilage or ligament damage from lotus and half lotus, hero pose, deep squats, kneeling work and twisting on a loaded knee.
Sacroiliac joint pain. Practising without modification risks aggravation from asymmetric forward folds, deep twists and single leg loading.
Ankle injury or instability. Practising without modification risks re-sprain from balance postures, single leg standing work and standing reformer or jump board work.
Any current or recent musculoskeletal injury not listed above. Practising without modification risks making it worse. One in five pre-existing injuries was made worse by yoga in the one prospective study, and over a third of yoga related pain stopped practice for more than 3 months.
70. By taking part in an activity, you acknowledge that you have had a reasonable opportunity to consider this risk warning before taking part.
71. Appendix B sets out the liability, release and indemnity clauses for services supplied at Potts Point, New South Wales. It forms part of these terms.
72. Nothing in the appendix removes any guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
73. We do not take custody of your belongings. The lockers are there for you to use while you are with us, and what is in them stays yours. Leave anything precious at home and bring only what you need.
74. You are responsible for your personal belongings brought onto the premises. To the maximum extent permitted by law, we are not responsible for loss of or damage to your personal property, except to the extent caused by liability that cannot lawfully be excluded, restricted or modified.
75. Lockers are for the length of your visit. Anything left in the studio at closing we hold for 2 weeks, then donate to charity or dispose of.
76. Tell us if a locker is not working and we will take it out of service.
77. We collect personal information so we can run your membership, teach you and stay in touch. Our privacy policy at onehotyoga.com.au/privacy explains how we handle it, how to see or correct it, and how to raise a concern.
78. At an initial consultation or a private session, and on any health screening form, we collect health information. We use it to spot anything that makes a movement unsafe for you, to adapt your session, and to teach you well, and we share it with the teachers who teach you. We will not collect it without your consent, and if you would rather not give it there may be sessions we cannot offer you.
79. We use Momence for bookings and memberships and Stripe for payments. Both hold information in the United States. Our privacy policy has the detail.
80. Our names, logos, class formats, teaching materials, images and website content are ours. Please do not copy, reproduce, distribute or commercially use them without our written consent.
81. Email one@onehotyoga.com.au. We will come back to you within 5 business days and work it out with you.
82. If we cannot resolve it between us, NSW Fair Trading is at nsw.gov.au/fair-trading or 13 32 20.
83. We may transfer our rights and obligations under these terms to someone else, including on a sale of the business, as long as they take on our obligations to you. We will tell you in writing if we do, and you may cancel without a cancellation fee and without serving the notice period in clause 38.
84. These terms are governed by the law of New South Wales.
85. If any part of these terms cannot be enforced, it comes out and the rest still stands.
The name, price, billing cycle, access and expiry date for every membership, pass and class pack are shown at the point of purchase and in your account, and form part of your agreement with us. This Schedule sets out the rules around them.
Ongoing memberships. Minimum term of 8 weeks from the day you join. Billed on the cycle shown for the membership. Continue until you cancel under clause 37.
Class packs. Expire 6 months from purchase. Unused classes do not carry over. Not subscriptions. No minimum term, and they do not renew on their own.
Casual classes. Valid 1 month from purchase.
Intro offers. One per person, and not available if you are already on an ongoing membership. Valid for the period shown at purchase, running from your first class rather than the day you bought it. Not transferable or extendable. Standard booking, cancellation and waitlist rules apply. Because an intro offer is a limited membership, a late cancellation or no-show counts the class as used and there is no fee.
Private sessions and appointments. Booked and paid for separately. Not part of any membership. Cancel at least 24 hours ahead. Inside that, or if you do not come, the session is counted as used.
Workshops. Booked and paid for separately. Not part of any membership. Cancel at least 48 hours ahead and we will issue a credit note for what you paid, good for 12 months. Inside that, or if you do not come, the booking is forfeited. If we cancel or move a workshop, take the new date or have your money back.
Gift cards. Redeemable for at least 3 years from the day they are bought. The expiry date is on the card. Not exchangeable for cash, and no fee after purchase.
These clauses apply to services supplied at our Potts Point studio. The supplier is One Hot Yoga Sydney Pty Ltd ACN 169 300 430 as trustee for the OHP Trust.
In this appendix, Released Parties means One Hot Yoga Sydney Pty Ltd ACN 169 300 430 as trustee for the OHP Trust, and its owners, directors, employees, teachers, contractors and agents.
We give you the following risk warning before you take part in the activities.
Yoga, Pilates and related physical activities involve risks of physical injury, including strains, sprains, falls, muscle or joint injury, aggravation of pre-existing conditions and other physical harm. In rare circumstances, serious injury or death. You should take part only to the extent appropriate for your individual circumstances, and you should seek medical advice where appropriate before starting or continuing.
The risks, and the conditions that heighten them, are set out in clauses 58 to 69.
You acknowledge that taking part in the activities involves inherent and other risks. These risks may include, without limitation, muscle soreness, strains, sprains, falls, loss of balance, aggravation of pre-existing injuries or medical conditions, physical or psychological injury and, in rare circumstances, serious injury or death.
You voluntarily choose to take part in the activities and acknowledge that you do so at your own risk, subject to any rights that cannot lawfully be excluded, restricted or modified.
If you fall within any category of physical or medical risk set out in clause 69, you must tell us in writing before you attend our Potts Point studio. If you develop such a condition while we are providing the activities to you, you must tell us in writing immediately.
If you have concerns that you may sustain physical injury or harm by taking part in any of the activities, you must raise those concerns with a qualified medical practitioner.
You acknowledge that we do not give medical advice and do not represent that any particular activity is suitable for your individual physical condition.
To the maximum extent permitted by law, you release and discharge the Released Parties from liability for any loss, damage, injury, claim or expense arising out of or in connection with your participation in the activities, including liability arising from the provision of the recreational services, except to the extent that such liability cannot lawfully be excluded, restricted or modified.
You acknowledge that this clause is intended to operate to the extent permitted by section 5N of the Civil Liability Act 2002 (NSW), including in respect of liability arising from a breach of an express or implied warranty that the recreational services will be provided with reasonable care and skill.
So far as the law allows, the Released Parties limit their liability for death or personal injury arising from recreational services supplied at Potts Point. The limit covers death and personal injury only, and nothing else. It does not apply to significant personal injury caused by reckless conduct within the meaning of section 139A(5) of the Competition and Consumer Act 2010 (Cth).
You acknowledge that you have been informed that taking part in the activities involves risks, and that you voluntarily accept those risks.
You acknowledge that you are responsible for determining whether you are physically and medically able to take part, and that you will tell us and your teacher, before taking part, of any injury, medical condition, physical limitation or other circumstance that may affect your ability to take part safely.
You confirm that you have read our warning about the conditions that carry a heightened risk of serious harm and injury in clause 69, and that you have told us if any of them applies to you before taking part.
You agree to follow reasonable instructions and safety directions given by us and our teachers, and to stop taking part if you experience pain, dizziness, illness or other symptoms that cause you concern.
To the maximum extent permitted by law, you indemnify the Released Parties against any claim, loss, liability, damage, cost or expense incurred by a Released Party to the extent that it is caused or contributed to by:
This indemnity does not apply to the extent that the relevant loss, liability, damage, cost or expense is caused by the negligence, unlawful conduct or other liability of a Released Party that cannot lawfully be excluded, restricted or indemnified.
Nothing in these terms is intended to exclude, restrict or modify any right or remedy that cannot lawfully be excluded, restricted or modified, including rights or remedies under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law, the Civil Liability Act 2002 (NSW), or any other applicable legislation.
To the extent that any provision of these terms is incapable of being excluded, restricted or modified, that provision will apply only to the extent permitted by law.
